Requirements for Florida 3 Day Notice

The requirements for a Florida 3 Day Notice need to be strictly adhered to in order to avoid delay

 

Are you a Florida Landlord, Florida Property Manager, Florida Property Owner, or Florida Investor? Do you have a Florida Tenant who is not current on Rent and you need to begin the Florida Eviction Process?

 

One of the first steps in the Eviction Process is to provide your Tenant with a three -day notice. However, it is very important to comply with Chapter 83 of the Florida Statutes. What are the Requirements for Florida 3 Day Notice? Pursuant to Florida Statute 83.56(3), the 3 Day Notice to Pay or Vacate must state:

 

(1) the amount of dollars that the Tenant is indebted to the Landlord for the use and possession of the property;

(2) the property address;

(3) payment must be made within three (3) days (excluding Saturday, Sunday and legal holidays);

(4) the date the payment is due; and

(5) and the Landlord’s name, address and phone number.

 

Although the wording does not have to be identical, the format must be in the substantial same format as described above. If the 3 Day Notice is defective, the Florida Tenant can potentially argue for dismissal of the action however, courts in Florida allow the Florida Landlord to amend pleadings/notices in an Eviction action. This would not dismiss the case but it would extend the timeframe for the eviction.

 

It is important to ensure that the 3 Day Notice is accurate as it is a pre-requisite to filing the Florida Eviction action. The 3 Day Notice provides proper notice to the Florida Tenant that an Eviction action is forthcoming if payment is not received and that the rental agreement will be terminated if payment is not received.
