Florida Residential Evictions And Court Holidays

Evictions in Florida are governed under Chapter 83, Florida Statutes. Traditionally, if a landlord follows the law and correctly hits pertinent deadlines in their eviction cases, evictions are designed to be an expedited court process in order to place the landlord back in possession of their real property. However, incorrectly counting holidays or weekends in the Florida eviction process can cause for unnecessary delay.

In  Florida, a 3-Day Notice must not be given prior to the rent becoming due and it must state that that that tenant has 3 days to pay the overdue rent or vacate the property. The notice should exclude Saturdays, Sundays and legal holidays, those days observed by a court as set forth in §83.56(3),

In all eviction actions for possession, the landlord is entitled to summary procedure as provided in §51.011, Fla. Stat. Upon being served with an eviction lawsuit, a tenant has 5 days to file an answer to the eviction claim.  See Berry v. Clement, 346 So. 2d 105 (Fla. 2d DCA 1977), 5 days excludes weekends and legal holidays. Fla. R. Civ. P. 1.090(a).  An answer is required to be filed within 5 days excluding weekends and legal holidays and should contain all legal and equitable defenses.

§83.62(1), Fla. Stat., which is titled Restoration of possession to landlord, states that “[I]n an action for possession, after entry of judgment in favor of the landlord, the clerk shall issue a writ to the sheriff describing the premises and commanding the sheriff to put the landlord in possession after 24 hours’ notice conspicuously posted on the premises. Saturdays, Sundays, and legal holidays do not stay the 24-hour notice period.”  This 2013 amendment to the statute clarifies that weekends and holidays do not stay the 24 hour notice period for the sheriff’s eviction.  This appears to permit eviction on a Saturday, Sunday, or holiday based upon a notice posted the previous day; however, service of a writ of possession on a weekend is extremely rare.
